Terms and Conditions for Tree Surgeons Ilford
These Terms and Conditions set out the basis on which Tree Surgeons Ilford provides tree surgery and related arboricultural services to customers in the United Kingdom. By requesting a quotation, making a booking, or allowing work to proceed on site, the customer agrees to these terms. They are designed to create a clear, fair, and practical agreement for both parties, covering the booking process, payments, cancellations, liability, waste regulations, and governing law. These terms apply to domestic and commercial customers unless otherwise agreed in writing. They should be read alongside any written quotation, estimate, scope of works, or job confirmation issued before the service begins. If there is any inconsistency between these terms and a specific written agreement, the written agreement will take priority to the extent of the inconsistency. The customer should review all documents carefully before proceeding.
For the avoidance of doubt, these terms do not replace any rights the customer may have under UK law, including consumer rights where applicable. Nothing in these terms is intended to exclude liability that cannot legally be excluded. The purpose of the document is to provide a balanced framework for tree care services, including pruning, crown reduction, hedge work, tree removal, stump grinding, arboricultural advice, and associated site clearance.
Booking process begins when the customer submits an enquiry and provides reasonable details of the required work. This may include the type and number of trees, access conditions, photographs, site location, and any relevant restrictions. A quotation or estimate may be based on the information supplied and may be subject to change if the site conditions differ from those described. The customer is responsible for ensuring the information provided is accurate and complete. Where a visit is required before a final price can be confirmed, any inspection fee will be explained in advance, if applicable.
Once the customer accepts the quotation, a provisional date may be arranged. A booking is only confirmed when Tree Surgeons Ilford issues written confirmation, or otherwise clearly accepts the booking in writing. In some cases, a deposit may be required to secure the appointment. The customer must ensure that the site is accessible on the agreed date and that any relevant permissions, consents, or notices have been obtained before work starts. This includes, where applicable, planning constraints, conservation area considerations, landlord approval, or permission from neighbouring parties.
Work schedules may need to change because of weather, safety concerns, equipment availability, staffing, or unforeseen site conditions. In such cases, a new date will be offered where reasonably possible. If payment is not made by the due date, Tree Surgeons Ilford may charge statutory interest and compensation in line with applicable UK debt recovery legislation for business customers, and may take reasonable steps to recover the debt. The customer will remain liable for all reasonable costs of recovery to the extent permitted by law. No set-off, withholding, or deduction may be made unless required by law or expressly agreed in writing. Where a quotation is based on a site survey but the actual work differs materially, the final price may be adjusted to reflect extra labour, disposal, machinery, or risk.
The company may request advance payment for materials, specialist plant, traffic management, road permits, or unusually large waste volumes. This is particularly relevant where tree surgery jobs involve heavy timber, access challenges, or prolonged operations. Invoices should be checked carefully upon receipt. Any query relating to an invoice must be raised promptly and in good faith. Failure to raise a query does not remove the obligation to pay the undisputed amount by the due date.
Cancellations and rescheduling are permitted, but the customer should notify Tree Surgeons Ilford as soon as possible if a booking must be changed or cancelled. Because tree surgery often requires staff, equipment, and waste transport to be reserved in advance, short-notice cancellations may result in a charge. Where a deposit has been paid, it may be retained in whole or in part to cover reasonable losses, administration costs, or wasted attendance, unless the law requires otherwise. The exact amount retained will depend on the timing and circumstances of the cancellation.
If the customer cancels after work has started, payment may still be due for all work completed, materials supplied, and any costs reasonably incurred up to the point of cancellation. If adverse weather, unsafe conditions, or legal restrictions prevent the work from being completed, Tree Surgeons Ilford may reschedule without penalty to the extent reasonably possible. However, where the customer has failed to provide access, permissions, or required information, any wasted visit or delay caused by that failure may be charged.
Customers who are consumers may have cancellation rights in certain circumstances under the Consumer Contracts Regulations 2013, where the contract is concluded at a distance or off-premises and no applicable exemption applies. If the customer requests that the work begin within the cancellation period, they may be required to acknowledge that they are asking for immediate performance and may lose the right to cancel once the service has been fully performed, or may be liable for a proportionate charge for work already carried out. This will be explained where relevant.
Liability is limited to the extent permitted by law. Tree Surgeons Ilford will exercise reasonable skill and care in carrying out all services. The company will take reasonable precautions to avoid damage to property, utilities, structures, and planted areas, but tree surgery is inherently risky and some degree of disturbance may be unavoidable. The customer should remove or protect fragile items, ornaments, vehicles, pots, and other valuables from the working area before the work begins.
The company is not responsible for pre-existing defects, hidden decay, underground services, unstable structures, poor access conditions, or damage resulting from circumstances beyond its control. The customer is responsible for notifying the company of any known hazards, including power lines, drains, septic systems, underground cables, asbestos, weak roofs, boundary disputes, or protected features. Where the customer instructs the company to proceed against professional advice, the company may refuse to carry out the instruction or may do so only with a written disclaimer where lawful and appropriate.
Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded. Subject to that, the company shall not be liable for indirect, consequential, or special losses, including loss of profit, loss of business, or loss of amenity. Any claim for damage or loss must be reported as soon as reasonably possible and, in any event, within a reasonable time after the event. The company may ask for photos, access to the site, and other evidence to assess the claim fairly.
Waste regulations are an important part of all tree surgery work. Tree Surgeons Ilford will manage green waste, timber, branches, brash, and related debris in a manner intended to comply with applicable UK waste laws and duty of care requirements. Unless otherwise agreed, waste removed from site will be transported and handled by the company or its appointed waste contractor. Where the customer requests retention of timber, logs, mulch, or arisings, this must be agreed before the job starts and may alter the price or the scope of works.
The customer must not ask the company to dispose of waste unlawfully or in a way that would breach environmental rules. Waste must be taken only to authorised facilities, recycled where practical, or otherwise managed in accordance with current legislation. The company may provide transfer notes, invoices, or other records if required by law or by the nature of the work. If hazardous materials are discovered during the job, the company may suspend work until the hazard is assessed and a lawful disposal method is identified.
Any material left on site at the customer’s request becomes the customer’s responsibility once the work has been completed and accepted, unless the parties agree otherwise. The customer should ensure that any retained timber or wood chips are stored safely and in a suitable condition. The company accepts no responsibility for subsequent movement, decay, infestation, or use of retained material after completion, except where required by law or expressly agreed in writing.
Access, permissions, and site conditions are the customer’s responsibility unless otherwise agreed. The customer must ensure that the company can safely access the work area at the arranged time and that gates, keys, codes, parking arrangements, and any necessary escorts are available. If access is delayed or prevented, additional charges may apply where the delay causes extra labour, travel, or waiting time. The customer must also ensure that pets, children, and unauthorised persons are kept away from the work zone during operations.
The company may take photographs or brief records of the work before, during, and after completion for job management, safety, and evidential purposes. These records may also assist in confirming the scope of works, documenting hazards, or assessing any complaint. Such records will be handled in line with applicable data protection requirements where personal data is involved. Where trees are subject to legal protection or planning controls, the customer must disclose this before work begins.
Title to any goods or materials supplied remains with Tree Surgeons Ilford until payment has been received in full, where such retention is lawful and applicable. Risk in completed works may pass to the customer upon completion and acceptance of the service, subject to the nature of the job and any express agreement to the contrary. If the customer asks the company to leave the site before the agreed work is finished, the company may treat the instruction as a partial completion and invoice accordingly.
Complaints and dispute handling should be raised promptly and in writing so that issues can be investigated fairly. The customer should provide a description of the concern, the date of the work, and any relevant photographs or other evidence. Tree Surgeons Ilford will review the matter in a reasonable time and may offer a revisit, clarification, remedial work, or another suitable response where appropriate. The company will not be liable for matters that arise from normal tree behaviour, seasonal change, regrowth, or the natural characteristics of living trees.
If a dispute cannot be resolved informally, both parties should consider negotiation or other alternative dispute resolution before starting legal proceedings, where appropriate. Any failure to exercise a right or remedy immediately does not amount to a waiver of that right or remedy. If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force. The company may assign or subcontract parts of the work where appropriate, provided the service standards remain reasonable.

The version in force at the time the booking is accepted will normally apply to that booking, unless a later change is agreed in writing by both parties. The company’s decision to exercise a contractual right on one occasion does not prevent it from exercising that right later.
Governing law and jurisdiction: These Terms and Conditions, and any dispute or claim arising out of or in connection with them, shall be governed by and interpreted in accordance with the laws of England and Wales. Subject to any applicable consumer protections, the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from the services supplied by Tree Surgeons Ilford. If the customer resides in Scotland or Northern Ireland, mandatory local consumer rights may still apply where the law requires.
The parties agree that these terms form the entire agreement relating to the services, except for any written variation agreed by both parties. No person other than the customer and Tree Surgeons Ilford has any right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999, unless expressly stated otherwise in writing. By proceeding with a booking, the customer confirms that they have read, understood, and accepted these terms in relation to the relevant tree surgery work.
